ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਭਾਈ ਬਲਵੰਤ ਸਿੰਘ ਰਾਜੋਆਣਾ ਨੂੰ ਅੰਤਰਿਮ ਰਾਹਤ ਦੇਣ ਤੋਂ ਕੀਤਾ ਇਨਕਾਰ, ਮਾਮਲੇ ਦੀ ਅਗਲੀ ਸੁਣਵਾਈ 18 ਨਵੰਬਰ ਨੂੰ
ਨਵੀਂ ਦਿੱਲੀ 4 ਨਵੰਬਰ (ਮਨਪ੍ਰੀਤ ਸਿੰਘ ਖਾਲਸਾ):- ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਪੰਜਾਬ ਦੇ ਸਾਬਕਾ ਮੁੱਖ ਮੰਤਰੀ ਬੇਅੰਤ ਸਿੰਘ ਦੇ ਕਤਲ ਵਿਚ ਨਾਮਜਦ ਭਾਈ ਬਲਵੰਤ ਸਿੰਘ ਰਾਜੋਆਣਾ ਦੀ ਮੌਤ ਦੀ ਸਜ਼ਾ ਨੂੰ ਘਟਾਉਣ ਦੀ ਮੰਗ ਕਰਨ ਵਾਲੀ ਪਟੀਸ਼ਨ ‘ਤੇ ਮਾਮਲੇ ਦੀ ਵਿਸਥਾਰ ਨਾਲ ਸੁਣਵਾਈ ਕੀਤੇ ਬਿਨਾਂ ਕੋਈ ਅੰਤਰਿਮ ਰਾਹਤ ਦੇਣ ਤੋਂ ਇਨਕਾਰ ਕਰ ਦਿੱਤਾ। ਜਸਟਿਸ ਬੀ.ਆਰ.ਗਵਈ ਦੀ ਪ੍ਰਧਾਨਗੀ ਵਾਲੇ ਤਿੰਨ ਜੱਜਾਂ ਦੇ ਬੈਂਚ ਨੇ ਪੰਜਾਬ ਸਰਕਾਰ ਨੂੰ ਭਾਈ ਬਲਵੰਤ ਸਿੰਘ ਰਾਜੋਆਣਾ ਦੀ ਪਟੀਸ਼ਨ ‘ਤੇ ਜਵਾਬ ਦੇਣ ਲਈ ਦੋ ਹੋਰ ਹਫ਼ਤਿਆਂ ਦਾ ਸਮਾਂ ਦਿੱਤਾ ਹੈ ਅਤੇ ਅਗਲੀ ਸੁਣਵਾਈ 18 ਨਵੰਬਰ ਨੂੰ ਤੈਅ ਕੀਤੀ ਹੈ। ਰਿੱਟ ਪਟੀਸ਼ਨ ਵਿੱਚ ਰਾਸ਼ਟਰਪਤੀ ਦੁਆਰਾ ਉਸਦੀ ਰਹਿਮ ਦੀ ਅਪੀਲ ਦਾ ਫੈਸਲਾ ਕਰਨ ਵਿੱਚ “ਅਸਾਧਾਰਨ” ਅਤੇ “ਅਸਾਧਾਰਨ ਦੇਰੀ” ਦੇ ਅਧਾਰ ‘ਤੇ ਉਸਦੀ ਮੌਤ ਦੀ ਸਜ਼ਾ ਨੂੰ ਘਟਾਉਣ ਦੀ ਮੰਗ ਕੀਤੀ ਗਈ ਸੀ।
ਅਦਾਲਤ ਅੰਦਰ ਭਾਈ ਬਲਵੰਤ ਸਿੰਘ ਰਾਜੋਆਣਾ ਵੱਲੋਂ ਪੇਸ਼ ਹੋਏ ਸੀਨੀਅਰ ਐਡਵੋਕੇਟ ਮੁਕੁਲ ਰੋਹਤਗੀ ਨੇ ਕਿਹਾ ਕਿ ਉਹ ਅੱਜ ਤੱਕ 29 ਸਾਲਾਂ ਤੋਂ ਬਿਨਾਂ ਕਿਸੇ ਰੁਕਾਵਟ ਦੇ ਜੇਲ੍ਹ ਅੰਦਰ ਹਿਰਾਸਤ ਵਿੱਚ ਹਨ। ਸੀਨੀਅਰ ਵਕੀਲ ਨੇ ਕਿਹਾ ਕਿ ਰਹਿਮ ਦੀ ਅਪੀਲ ‘ਤੇ ਫੈਸਲਾ ਕਰਨ ‘ਚ ਦੇਰੀ ਹੈਰਾਨ ਕਰਨ ਵਾਲੀ ਹੈ।
ਇੱਕ ਖਾਸ ਸਵਾਲ ਦੇ ਜਵਾਬ ਵਿੱਚ, ਪੰਜਾਬ ਸਰਕਾਰ ਦੇ ਵਕੀਲ ਨੇ ਜਸਟਿਸ ਪ੍ਰਸ਼ਾਂਤ ਕੁਮਾਰ ਮਿਸ਼ਰਾ ਅਤੇ ਕੇਵੀ ਵਿਸ਼ਵਨਾਥਨ ਦੀ ਬੈਂਚ ਨੂੰ ਦੱਸਿਆ ਕਿ ਉਹ ਉਸ ਪਟੀਸ਼ਨ ਦਾ ਜਵਾਬ ਦਾਖਲ ਕਰਨ ਦੇ ਯੋਗ ਨਹੀਂ ਸੀ ਜਿਸ ‘ਤੇ ਅਦਾਲਤ ਨੇ 27 ਸਤੰਬਰ ਨੂੰ ਨੋਟਿਸ ਜਾਰੀ ਕੀਤਾ ਸੀ।
ਅੰਤਰਿਮ ਰਾਹਤ ਦੀ ਮੰਗ ਕਰਦੇ ਹੋਏ ਰੋਹਤਗੀ ਨੇ ਕਿਹਾ, “29 ਸਾਲਾਂ ਬਾਅਦ, ਜਿਨ੍ਹਾਂ ਵਿੱਚੋਂ 15 ਸਾਲ ਉਹ ਮੌਤ ਦੀ ਸਜ਼ਾ ‘ਤੇ ਰਹੇ ਹਨ, ਉਨ੍ਹਾਂ ਨੇ ਮੇਰੀ ਰਹਿਮ ਦੀ ਅਪੀਲ ਦਾ ਨਿਪਟਾਰਾ ਨਹੀਂ ਕੀਤਾ ਹੈ, ਜਦੋਂ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਹੋਰਨਾਂ ਦੀ ਸਜ਼ਾਵਾਂ ਨੂੰ ਉਮਰ ਕੈਦ ਵਿੱਚ ਤਬਦੀਲ ਕਰ ਦਿੱਤਾ ਹੈ।” ਉਸਨੇ ਧਿਆਨ ਦਿਵਾਇਆ ਕਿ ਭਾਈ ਬਲਵੰਤ ਸਿੰਘ ਰਾਜੋਆਣਾ ਦੀ ਮੌਤ ਦੀ ਸਜ਼ਾ ਨੂੰ ਘਟਾਉਣ ਦੀ ਮੰਗ ਕਰਨ ਵਾਲੀ ਪਿਛਲੀ ਪਟੀਸ਼ਨ ਦਾ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਮਈ 2023 ਵਿੱਚ ਨਿਪਟਾਰਾ ਕਰ ਦਿੱਤਾ ਸੀ, ਜਿਸ ਵਿੱਚ ਕਿਹਾ ਗਿਆ ਸੀ ਕਿ “ਉਹ (ਅਧਿਕਾਰੀਆਂ) ਰਹਿਮ ਦੀ ਅਪੀਲ ‘ਤੇ ਸਮੇਂ ਸਿਰ ਕਾਰਵਾਈ ਕਰਨਗੇ।”
New Delhi (Manpreet Singh Khalsa): The Supreme Court has refused to grant interim relief in a petition seeking the commutation of Bhai Balwant Singh Rajoana’s death sentence. Rajoana, convicted in the assassination of former Punjab Chief Minister Beant Singh, had petitioned for the commutation on grounds of “extraordinary” and “unjustified delay” by the President in deciding on his mercy plea. A three-judge bench headed by Justice B.R. Gavai gave the Punjab government two additional weeks to respond to Rajoana’s petition, with the next hearing scheduled for November 18.
Senior Advocate Mukul Rohatgi, appearing for Rajoana, argued that Rajoana has been in custody for an uninterrupted 29 years, with 15 years spent on death row, highlighting the prolonged delay in deciding his mercy plea. Rohatgi noted that despite the Supreme Court’s directive in May 2023 for authorities to act promptly on Rajoana’s mercy plea, the delay has persisted.
Responding to specific questions, the counsel representing the Punjab government informed Justices Prashant Kumar Mishra and K.V. Viswanathan that they had not yet been able to submit a response to the petition after the Supreme Court issued a notice on September 27. Rohatgi further emphasized the inequity, pointing out that in similar cases, the Supreme Court had commuted other death sentences to life imprisonment.
